Effective 19 October 2026. The agreement between you and Eyinsan Odugba for using everyPilot.
These Terms of Use (“Terms”) are an agreement between you and Eyinsan Odugba (“we”, “us”, “our”), the publisher of the everyPilot app (“everyPilot” or the “app”). By tapping “Agree and continue”, or by using the app, you agree to these Terms. If you don’t agree, don’t use the app. Our Privacy Policy explains how information is handled and is part of these Terms.
Please read section 8 (aviation safety and regulations), sections 13–15 (warranties, liability and your consumer rights) and section 19 (how disputes are resolved, including binding individual arbitration for people in the United States). Nothing in these Terms takes away rights you have under consumer law that cannot be excluded.
everyPilot is an electronic pilot logbook and record-keeping tool. It helps you record flights and duty, keep track of currency, limits, certificates and endorsements, and print or export your records. It works offline and stores your logbook on your device.
You must be at least 13 years old to use everyPilot. If you are under the age of majority where you live, you may use it only with the agreement of a parent or guardian, who accepts these Terms for you. On iPhone, where a law requires apps to check age, the app asks Apple for your age range and does not open for users under 13. Some features rely on third-party services that set their own minimum age (for example, most AI providers require you to be 18 or older); you must meet those requirements to use them.
We grant you a personal, limited, non-exclusive, non-transferable licence, which ends only as described in section 12, to install and use everyPilot on devices you own or control, for your own record-keeping, in line with these Terms and the usage rules of the app store you got it from. We license the app to you; we do not sell it to you.
You may not: copy, modify or distribute the app except as the law allows; reverse-engineer or decompile it except to the extent the law expressly permits despite this restriction; remove notices; use the app to break any law or anyone else’s rights; or interfere with its security.
You own your logbook and everything you put into everyPilot. It is stored on your device and, if you turn on sync, in your own cloud account. We do not host it, cannot see it and cannot recover it. You are responsible for keeping backups (the app makes daily copies on your device and can save backup files and print your logbook), and for the accuracy of what you record.
Some features connect to services that other companies provide under their own terms and privacy policies, using your own accounts: iCloud, Google Drive, Dropbox, Microsoft OneDrive or a WebDAV server you choose (sync); Google Gemini, Anthropic Claude or OpenAI (AI reading, using your own API key, billed to you by the provider); Apple or Google (purchases); GitHub (the community board); Planespotters.net (photos of aircraft, when you tap for one); and calendar or roster addresses you enter. You are responsible for following those terms and for any charges from those providers. We are not responsible for those services, their availability or how they handle your data.
If you turn on AI reading, the photos or scans of logbook pages and the questions you choose to send (with your logbook’s field names, aircraft types, tail numbers and custom-field choices — never your flights) go directly from your device to the AI provider you picked, under your own account and its terms. We ask for your permission before anything is sent and you can withdraw it at any time. AI can misread handwriting, numbers, dates and times. Results are suggestions: you must check every entry before you save it, and you are responsible for what you save.
The everyPilot community board is hosted on GitHub, under GitHub’s terms; anything you post there is public. Never post logbook data, licence or certificate numbers, or other personal information. If you send us ideas or feedback, you allow us to use them without any obligation to you.
We may update, change or stop features of the app. Except as section 15 provides, we are not obliged to provide updates or support, but we aim to keep everyPilot working and to fix problems you report.
The app, its design, the everyPilot name and logo, and its content (other than your data) belong to us or our licensors. Text reproduced from government publications, such as FAA Advisory Circulars and regulations, is not ours. Open-source software and data in the app are used under their own licences, listed in the app under Me › Privacy & legal › Open-source licences & data sources; nothing in these Terms limits your rights under those licences.
You may stop using everyPilot at any time by deleting it (to erase your data first, use Me › Privacy & legal › Erase everything on this phone). If you seriously or repeatedly break these Terms, your licence ends. Sections that by their nature should continue — including 5, 8, 9 and 11 to 22 — continue after these Terms end.
TO THE FULLEST EXTENT PERMITTED BY LAW, EVERYPILOT IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR ITS CALCULATIONS WILL BE ACCURATE, COMPLETE, UP TO DATE, UNINTERRUPTED OR ERROR-FREE, OR THAT YOUR DATA WILL NOT BE LOST.
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, EMPLOYMENT OR OPPORTUNITY, OR ANY REGULATORY ACTION, FINE OR ENFORCEMENT, ARISING FROM OR RELATED TO THE APP OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP OR THESE TERMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR EVERYPILOT IN THE 12 MONTHS BEFORE THE CLAIM AND US$50.
These limits apply whatever the legal theory (contract, tort including negligence, product liability or otherwise). They do not limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for our gross negligence or wilful misconduct, or any other liability that cannot be limited or excluded by law.
Nothing in these Terms limits or excludes any right or remedy you have under consumer protection law that cannot be limited or excluded — for example the statutory rights of consumers in the European Union and the United Kingdom, or the consumer guarantees under the Australian Consumer Law. Where such a law applies, the disclaimers and limits in sections 13 and 14 apply only as far as that law allows. If you live in the European Union or the United Kingdom, we are responsible for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care and skill, and the US$50 minimum in section 14 does not reduce what you can recover under your local law. Where consumer law requires it (for example the EU Digital Content Directive), we will provide the updates, including security updates, needed to keep the app as described for the period that law sets.
To the extent permitted by law, you agree to compensate us for losses and costs (including reasonable legal fees) arising from claims by others caused by your breach of these Terms, your misuse of the app or your breaking the law. This section does not apply to you if you are a consumer in the European Union or the United Kingdom.
You confirm that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a “terrorist supporting” country, and that you are not on any United States Government list of prohibited or restricted parties. You agree to follow all export and sanctions laws that apply to your use of the app.
We may update these Terms, for example when the app or the law changes. We will show the date of the latest version in the app. If a change is material, we will ask you to agree to the new Terms in the app before you continue; if you don’t agree, you may stop using the app. Changes do not apply to a dispute that arose before the change.
Talk to us first: most problems can be solved quickly, so before starting any claim please email everyai007@gmail.com, or write to Eyinsan Odugba, PO Box 56001, Atlanta, GA 30343, United States, and give us 30 days to try to resolve it.
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules, and by the United States Federal Arbitration Act for the agreement to arbitrate below. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and — if you live in the European Union, the United Kingdom, Australia or another country whose law gives you that right — you may bring a claim in the courts where you live.
Binding individual arbitration (United States only). If you live in the United States, you and we agree to resolve any dispute arising from or relating to the app or these Terms by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court, except that either of us may bring an individual claim in small-claims court, or ask a court to stop the infringement or misuse of intellectual property. The arbitration may be held by video or in the county where you live. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION; claims may be brought only individually. If this class waiver is found unenforceable for a claim, that claim must be heard in court, not in arbitration. You may opt out of arbitration by emailing us or writing to us (contact details in section 22) within 30 days after you first agree to these Terms, saying that you opt out; opting out does not affect the rest of these Terms.
Any dispute not subject to arbitration will be heard exclusively in the state and federal courts located in Fulton County, Georgia, United States, and you and we consent to their jurisdiction, except where your local consumer law gives you the right to go to your own courts.
If you got everyPilot from the Apple App Store, these additional terms apply, and they prevail if they conflict with the rest of these Terms:
If you got everyPilot from Google Play, your purchase is also governed by the Google Play Terms of Service. Google is not responsible for everyPilot or its support.
